Terms of Service

These terms are an agreement between you and KONAH Media Group LLC, a Virginia company ("KONAH", "we"), for using konahmedia.com, the KONAH portal and the services you book. By creating an account or booking, you agree to them.

Accounts

You must be 18 or older and give accurate information. Keep your password private; you're responsible for activity on your account. Team leads are responsible for the agents they invite.

Services and booking

We provide real estate photography, drone, video, 3D, editing and related marketing tools. Your order is confirmed when KONAH confirms the date and time; payment is collected as shown at checkout, by payment link, or on an approved monthly invoice. Prices and package contents are shown when you book. For You Record, We Edit (Edit My Stuff), you upload your own photos or video; video edits are priced by finished length and include captions, music, branding and both sizes, and photo edits are priced per photo.

Media license

When we deliver your media you get a non-exclusive, perpetual license to use it to market that property and your own real estate services (MLS, listing sites, social media, print and your website). KONAH keeps the copyright and may show the work in our portfolio. You may not sell, sublicense or transfer the media to another agent or business, or use it for a different property, without our written permission.

Your content

When you upload photos, video, logos, documents or contacts (for example in Edit My Stuff, the Brand Kit or Leads), you confirm you have the right to use them and give us permission to store and edit them to provide the service. Don't upload anything unlawful or anything you don't have rights to.

Edits, AI and labels

Photo editing may tidy a room by removing loose personal items and light surface mess; it never adds, removes or changes permanent features of the home and never hides damage, stains or wear. Virtual staging is labeled as virtually edited. Many MLSs have rules about edited photos, and it's your job to follow your MLS rules. AI-generated reels, if offered, add camera movement only and do not add, remove or change features of the property. AI drafts (listing copy, captions, email replies) are suggestions: review them before you use them.

Fair Housing and your marketing

You're responsible for your listings, ads, property websites and messages, including following fair housing rules and the rules of your license, brokerage and MLS. Our listing-copy tool is built to describe the property, not the people who should live there, and flags risky wording, but you make the final call. Respond to leads lawfully, including honoring opt-outs.

Social media connections and posting

• Your authorization. When you connect Instagram, Facebook or TikTok, you authorize KONAH to publish the content you approve or schedule in your portal to the accounts you connect. If you subscribe to Social Media Management or a content plan that includes posting, you also authorize our team to publish content from your approved monthly calendar to your Facebook and Instagram accounts on your behalf. TikTok requires the account owner to approve each post personally, so we prepare TikTok posts and you confirm each one in your portal before it publishes. You confirm you own or are authorized to manage each account you connect.
• AI Social Media Manager. KONAH AI drafts posts, graphics, captions and replies for you to review. Drafts can be wrong; nothing is published until you approve it, and the checks we run (Fair Housing wording, brokerage disclosure, numbers to verify) are guardrails, not legal advice. Connections may run through our social connection provider (Zernio), which receives the access each platform grants so it can publish what you approve; you can disconnect any account at any time.
• Your responsibility. You are responsible for what is posted to your accounts, including content we prepare that you approve. You agree to follow each platform's terms and community guidelines, fair housing rules, advertising rules for your license (including brokerage and NMLS disclosures where required), and the rights of anyone who appears in or owns the content.
• Platforms are third parties. Instagram, Facebook and TikTok are run by Meta and TikTok, not KONAH. They can change features, limit reach, remove posts, delay publishing, or restrict or suspend accounts at any time. KONAH is not responsible for platform outages, policy or API changes, removed content, lost followers or reach, or account restrictions, and these don't entitle you to a refund except as stated in our Refund & Cancellation Policy.
• No guaranteed results. We don't guarantee followers, views, engagement, leads or sales from social media or any marketing we create.
• Disconnecting. You can disconnect an account any time from your portal or the platform's settings. Scheduled posts for that account won't publish after you disconnect.

Transaction Coordinator

The AI Transaction Coordinator helps organize dates, documents and emails. It is not a lawyer, escrow agent or title company, does not give legal advice, does not interpret contracts, and never sends anything for you. Always verify wiring instructions by calling a phone number you already know is real; never trust wiring changes sent by email.

Money Health and news

The Money Health letter and checklist are general education, not tax, legal or financial advice. Real estate news links to the original publishers. Talk to a licensed professional about your own situation.

KONAH Break Room, coins and game credits

• The Break Room's games, leaderboards and challenges are free. No purchase is necessary to play or win, there is no paid entry, and nothing is a game of chance.
• KONAH Coins and prizes are only for KONAH services. Coins have no cash value and can't be sold, transferred or exchanged for cash.
• Game credits: completing certain games and challenges can add KONAH service credit to your account wallet in fixed amounts (for example $5 or $10). Game credit applies automatically at checkout to KONAH services only, one game credit per order, on orders at or above the minimum shown in the portal, and expires after the period shown when it's earned. It is never paid out as cash, can't be transferred, has no cash-out, and is limited per month. KONAH may hold an award for review, decline awards that come from errors, misuse or impossible scores, and change or end the program at any time; credit already in your wallet stays until it expires.
• Leaderboards show your first name and last initial and your role or brokerage; you can hide yourself from public boards in the Break Room. Games never show your clients' information.
• AI practice games and coaching are general practice, not legal, tax or lending advice.

Subscriptions

KONAH CRM, the KONAH AI Social Media Manager and the Monthly Content Plan renew monthly until you cancel. You can cancel from your portal; service runs to the end of the period you've paid for. The AI Social Media Manager may start with a free trial: we email you 3 days and 1 day before it ends, and if you cancel during the trial you are not charged. Payment

You agree to pay the amounts shown. Unpaid confirmed orders may be released after the period shown in the portal. An unpaid balance may pause new bookings.

Access and safety

You're responsible for access on the day. Our team won't move heavy furniture, climb, or enter unsafe areas, and keeps what it sees inside a property confidential. Drone work depends on weather and airspace rules.

Acceptable use

Don't misuse the service: no attempts to break security, scrape, overload, or use it to send spam or unlawful content. We may suspend accounts that do.

Indemnity

You agree to defend, indemnify and hold harmless KONAH Media Group LLC, its owners, employees and contractors from claims, losses and costs (including reasonable attorneys' fees) arising from content you provide or approve, your listings and marketing, your use of the service in breach of these terms, or your violation of any law or anyone else's rights.

Disclaimer of warranties

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICE, MEDIA, AI FEATURES AND TOOLS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, KONAH DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, KONAH IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, COMMISSIONS, SALES, DATA OR GOODWILL. KONAH'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID KONAH FOR THE ORDER OR SUBSCRIPTION MONTH THAT GAVE RISE TO THE CLAIM.

Some places don't allow these limits, so they may not apply to you.

Time to bring a claim

Any claim relating to the service must be brought within one (1) year after it arises, or it is permanently barred, to the extent the law allows.

Force majeure

We're not responsible for delays or failures caused by events outside our reasonable control, including weather, airspace restrictions, illness, power or internet outages, platform or provider outages, or government action.

Copyright complaints

If you believe content on KONAH infringes your copyright, email [email protected] with the work, where it appears, your contact details and a statement that you believe in good faith the use isn't authorized. We'll review it and remove infringing content.

General

These terms, together with our Privacy Policy and Refund & Cancellation Policy, are the entire agreement between you and KONAH about the service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver.

You may not assign these terms without our consent; we may assign them as part of a merger or sale of the business. You agree to receive notices electronically. KONAH's photographers and editors may be independent contractors.

Ending your account

You can delete your account in the portal at any time. We may close accounts that break these terms. Sections that by their nature should continue (license, payment owed, limits) continue after closing.

Governing law and disputes

These terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. If we have a dispute, we'll first try to resolve it informally: send written notice to [email protected] and give us 30 days to work it out.

If it isn't resolved, the state or federal courts located in Prince William County, Virginia, have exclusive jurisdiction, and you and KONAH consent to those courts. Either of us may bring a qualifying claim in small claims court.

Changes

If we change these terms we'll update the date above and ask you to agree to the new version in the portal.
